An act to amend the Fair Labor Standards Act of 1938 to provide compensatory time for employees in the private sector.
Martha RobyEmployees could choose time off rather than overtime pay
This bill would allow companies to offer their employees the option of receiving overtime compensation as time off rather than money.
Employees who choose time off would receive 1-1/2 hours for each hour of overtime worked.
The choice would be the employee's, and an employee could "cash out" accrued time at any time. The company would have 30 days to reimburse the employee.
An employee could accrue up to 100 hours in a year. Any time not used at the end of a year would revert to pay.
A company would not be allowed to coerce an employee to chose compensatory time rather than pay.
