Why recess appointments aren't an issue.. for now
Through at least the end of 2014, the issue of recess appointments is likely to be a trivial one. That's because the Senate's Democratic majority acted in Nov. 2013 to not allow silent filibusters to block presidential appointments. A simple majority vote is all that is needed to confirm a nominee (other than nominations to the Supreme Court).
If the Republicans become the Senate's majority party after the 2014 elections, President Obama would no longer be able to count on majority approval of nominees. That would make issue of recess appointments relevant again.
